The following conditions regulate the contractual relationship between

§ 1 Scope of Application

These General Terms and Conditions (GTC) apply to all services provided by Care with Concept GmbH (hereinafter referred to as “CWC”) in the field of international recruitment and placement of qualified nursing professionals in Germany.

For the purposes of these GTC, customers include international nursing professionals (“candidates”), employers in the healthcare sector (“employers”), and users of the online platform.

Deviating terms and conditions shall not apply unless CWC has expressly agreed to them in writing.
 

§ 2 Conclusion of Contract

By making contact, submitting an inquiry, or applying, candidates or employers submit a non-binding request to conclude a contract with CWC.

A contract shall only be concluded once the respective contractual terms – in particular the scope of services and remuneration – have been individually agreed upon and expressly confirmed in writing by CWC (e.g., by email or by signing a contract).

CWC reserves the right to reject inquiries from candidates or employers at its own discretion and without stating reasons.
 

§ 3 Services of CWC

CWC provides services in the field of fair, ethical, and transparent international recruitment and placement of nursing professionals in Germany, in compliance with applicable legal requirements and fair recruitment principles.

The services of CWC may include in particular the following activities:

  • Initial consultation and needs analysis for candidates and employers

  • Review and structured preparation of application documents

  • Support during the professional recognition procedure

  • Full financing of language courses up to level B2

  • Creation of candidate profiles and matching with suitable employers

  • Preparation of candidates for selection and job interviews

  • Handling of visa, entry, and work permit procedures

  • Carrying out necessary official registrations in Germany

  • Implementation of relocation and integration measures

  • Ongoing support for nursing professionals after employment begins

The specific scope of services shall be determined by the standardized contractual basis of Care with Concept GmbH, which may be specified and supplemented in individual cases by additional agreements or individual contracts.

There is no entitlement to successful placement, to a specific job position, or to a specific employer.
 

§ 4 Principles of Fair and Ethical Recruitment

Care with Concept GmbH is committed to fair, transparent, and ethically responsible recruitment and placement practices for international nursing professionals.

Recruitment is carried out consistently in accordance with the employer-pays principle. Nursing professionals shall bear no direct or indirect costs for recruitment or services directly related to recruitment.

Care with Concept GmbH bases its services on the principles of fair recruitment, in particular internationally recognized human rights and labor standards.

The objective of recruitment is sustainable, long-term, and transparent cooperation for all parties involved, while safeguarding the freedom of choice of nursing professionals.
 

§ 5 Recognition Procedure

The recognition procedure for nursing professionals is governed by the statutory provisions in Germany, in particular the Nursing Professions Act (Pflegeberufegesetz).

The competent recognition authority decides in the recognition notice whether and which compensatory measures are required. The nursing professional generally has the freedom to choose between the prescribed compensatory measures, in particular between an adaptation period and a knowledge examination.

Care with Concept GmbH provides advisory support to the nursing professional during the recognition procedure without restricting the professional’s freedom of decision.
 

§ 6 Cost-Free Recruitment for Candidates (No-Fee Recruitment)

The placement services of Care with Concept GmbH are completely free of charge for candidates.

Candidates shall not bear any recruitment, placement, training, or placement-related costs. Repayment obligations, binding clauses, or contractual penalties to the detriment of candidates are excluded.

Recruitment-related costs (e.g., language courses, recognition procedures, visa and relocation costs) shall be borne by CWC or invoiced to the employer in accordance with individual agreements.

Before concluding a contract, Care with Concept GmbH shall transparently and appropriately inform the nursing professional which services are part of the recruitment process. Services that are not directly related to recruitment shall be considered optional additional services and may be used voluntarily or declined without disadvantage.

If, after successful completion of qualification or preparatory measures, no placement with an employer in Germany takes place, the nursing professional shall incur no costs; all costs incurred in connection with the recruitment process shall not be borne by the nursing professional.

This regulation is in accordance with the employer-pays principle and the principles of fair, transparent, and ethical recruitment.
 

§ 7 Remuneration of Employers

Employers shall pay remuneration for the recruitment services of CWC, the amount and scope of which shall be determined exclusively by the individually concluded recruitment or cooperation agreement.

The obligation to pay remuneration arises upon conclusion of the respective contract and applies in the version valid and signed by both parties.

Remuneration shall be due within 14 days after conclusion of the contract. Further payment modalities, installment payments, or performance-related components shall be determined exclusively by the respective contract.
 

§ 8 Obligations of Employers

Employers undertake to employ and remunerate the nursing professionals placed by Care with Concept GmbH in accordance with the applicable statutory, collective bargaining, or – if no collective agreement applies – customary local conditions for comparable domestic nursing professionals.

Employers shall ensure that the basic labor, social security, and immigration law requirements for the employment of the placed nursing professionals are complied with.

Employers undertake to actively support the integration of the placed nursing professionals within their operational possibilities. This includes in particular:

  • structured onboarding at the workplace,

  • designation of a suitable contact person in the company for professional and organizational matters,

  • a culture of appreciation and welcome in the working environment.

Employers shall support the placed nursing professionals, within their operational possibilities, in organizational and integration-related matters, in particular in connection with the start of work, operational processes, and social integration.

Employers undertake not to include inadmissible or non-transparent repayment, binding, or contractual penalty clauses in employment contracts or supplementary agreements with nursing professionals placed by Care with Concept GmbH.

Further integration or support services may be agreed separately between the employer and Care with Concept GmbH and are not part of these General Terms and Conditions.
 

Obligations of Candidates

Candidates undertake to provide CWC with complete, correct, and truthful information regarding their person, qualifications, professional experience, and language skills.

Candidates are obliged to provide required documents (e.g., training certificates, references, language certificates) completely and in a timely manner.

Candidates undertake to actively and responsibly participate in the measures предусмотрed in the recruitment process, in particular:

  • participation in language courses and qualification measures,

  • participation in agreed interviews and appointments,

  • compliance with the organizational instructions, procedures, and deadlines specified by CWC within the recruitment process, particularly in connection with documents, appointments, preparatory measures, and visa and recognition procedures.

Candidates undertake to notify CWC in writing of any changes in relevant personal circumstances (e.g., qualifications, availability, residence status) no later than seven calendar days after becoming aware of such changes.

In the event of serious breaches of duty, false information, or persistent refusal to cooperate, CWC shall be entitled to terminate the recruitment process for good cause.
 

§ 9 Free Decision of Candidates

Nursing professionals are not obliged to accept a job offer arranged by Care with Concept GmbH.

Rejection of a job offer by the nursing professional is possible at any time without stating reasons and shall not result in sanctions, contractual penalties, or any other adverse consequences for the nursing professional.
 

§ 10 Withdrawal and Early Termination

Provisions for Employers

If a nursing professional placed by CWC terminates the employment relationship for reasons for which they are responsible, the graduated reimbursement regulations contractually agreed between CWC and the employer at the beginning of the contract shall apply.

Inadmissible or non-transparent repayment or binding clauses shall not be accepted by CWC.

Provisions for the Protection of Nursing Professionals

Care with Concept places nursing professionals who do not enter into any reimbursement, repayment, or binding arrangements and who are not subject to any reimbursement obligations in the event of early termination or withdrawal.

Recruitment is carried out consistently in accordance with the employer-pays principle and the no-fee recruitment policy, according to which nursing professionals do not bear any fees or costs for their placement.
 

§ 11 Liability

CWC shall be liable without limitation in cases of intent and gross negligence.

In cases of slight negligence, CWC shall only be liable for breach of an essential contractual obligation (cardinal obligation). In this case, liability shall be limited to the typical, foreseeable damage.

Liability for damages resulting from injury to life, body, or health remains unaffected.

CWC shall not be liable for decisions, measures, or omissions by employers, authorities, recognition bodies, diplomatic missions, or other third parties, insofar as these are not attributable to the area of responsibility or influence of CWC.
 

§ 12 Limitation Period

Claims arising from the contractual relationship shall become time-barred, insofar as legally permissible, within one year from knowledge of the claim, but at the latest upon expiry of the statutory maximum limitation periods.

This shall not affect claims arising from injury to life, body, or health, nor claims based on intent or gross negligence.
 

§ 13 Contract Language
 

The contract language shall be German.

If contractual documents or information are additionally provided in another language, the German version shall prevail for purposes of interpretation in case of doubt.
 

§ 14 Data Protection

CWC processes personal data exclusively in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and relevant national data protection laws.

Personal data shall be processed exclusively for the purpose of providing recruitment services, supporting the recognition procedure, preparing the employment relationship, and facilitating integration.

Personal data shall only be disclosed to third parties insofar as this is necessary to carry out the recruitment process (e.g., to employers, authorities, recognition bodies), is legally required, or is based on the explicit consent of the data subject.

§ 15 Complaints Management

Care with Concept GmbH provides a transparent and confidential complaints management system.

Complaints may be submitted in writing or in text form to Care with Concept GmbH, in particular by email to:

Incoming complaints shall be reviewed promptly and processed within a reasonable period of time. The complainant shall receive feedback on the outcome of the review.

Complaints shall be handled confidentially and without any disadvantage to the complainant.
 

§ 16 Right of Withdrawal

Consumers have the following right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period shall be fourteen days from the date of conclusion of the contract.

by means of a clear statement (e.g., by letter or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send the notification before the withdrawal period has expired.
 

§ 17 Confidentiality and Secrecy

The contracting parties undertake to treat all confidential information obtained in the course of cooperation, in particular personal data, business and trade secrets, as confidential.

The obligation of confidentiality shall continue to apply after termination of the contractual relationship.

Statutory disclosure obligations shall remain unaffected.
 

§ 18 Written Form / Text Form / Ancillary Agreements

Amendments or supplements to these General Terms and Conditions and other contractual agreements shall require text form.

This shall also apply to any amendment or waiver of this text form requirement.

There are no oral ancillary agreements.
 

§ 19 Place of Jurisdiction

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with this contractual relationship shall be the registered office of Care with Concept GmbH.

For consumers, the statutory place of jurisdiction shall apply.
 

§ 20 Severability Clause

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

In place of the invalid provision, a provision shall be deemed agreed that comes closest to the economic purpose of the invalid provision in a legally permissible manner.
